There was a motion to accept the minutes of the June 30th meeting with 1 correction.  The   motion was seconded and accepted with a vote of 3-0-1; 3 Yes, 0 No, 1 Abstention.

There was a motion to accept the minutes of the July 14th meeting with 1 correction.  The motion was seconded and accepted with a vote of 3-0-1; 3 Yes, 0 No, 1 Abstention.

There was a motion to nominate Andrew Riordan as an Associate Member of the Conservation Commission.  The motion was seconded and accepted with a vote of 4-0-0.

Continued - Public Hearing – Notice of Intent – 3 Maple Brook Lane – Addi - CE159-1021  
Mr. Donald Nielsen, Engineer of Guerriere & Halnon, Mr. Zack Addi, the applicant, and Ms. Jane Cote of Star Pools, all appeared before the Commission for the construction of an in-ground swimming pool.  Mr. Nielsen stated that he has submitted a revised plan for review and gave the Commission an overview of these revisions to the plans.

Mr. Nielsen informed the Commission members that he has researched the prices of the plant species recommended by the Commission and has determined that they are extremely expensive for the applicant.  He requested that the applicant be allowed to extend these plantings over a season into next year; one-third during each of the next 3 growing seasons.

The consensus of the Commission members was that this would be acceptable.

Special conditions discussed with the applicant were:

  • no chlorine and no backwashing filters
  • perpetual condition – the limit of disturbance would be along the top of the
        slope where the boulders will be placed
  • 85% survivability for the shrubs
  • 100% survivability for the canopy trees
  • plantings to begin this year at the bottom of the slope and to be completed by October 2012
  • no hazardous chemicals shall be stored in the shed
  • less than 5 gallons of gasoline in the shed and less than 10 lbs. of fertilizer/lawn chemicals to be stored in the shed
  • Conservation placard to be placed on concrete bound
There was a motion to close the hearing for 3 Maple Brook Lane.  The motion was seconded and accepted with a vote of 4-0-1; 4 Yes 0 No, 1 Abstention.

There was a motion to issue State and Local Orders of Conditions for 3 Maple Brook Lane with 8 Special Conditions as listed above.  The motion was seconded and seconded with a vote of
4-0-1; 4 Yes, 0 No, 1 Abstention.


Continued - Public Hearing – Notice of Intent – 3 Forge Parkway – Stantec - CE159-1018
Mr. Steve Senna, a representative of National Development, and Mr. Jason Miller, Landscape Architect of Stantec, both appeared before the Commission for construction of a 37, 600 sq. ft. building with parking area.  

Mr. Senna submitted revised plans for the Commission’s review and gave a detailed overview of these plans.  These plans incorporate all of the comments from the Commission, the Planning Board and Conservation Staff.

Mr. Alfieri informed the applicant and Commission that all of his comments have been addressed by the applicant.

A perpetual condition would be no snow storage within Conservation jurisdiction.

There was a motion to close the public hearing for 3 Forge Parkway.  The motion was seconded and accepted with a vote of 4-0-1; 4 Yes, 0 No, 1 Abstention.


There was a motion to note that the applicant has satisfied their burden to demonstrate no significant adverse impact and to issue a permit with 56 Orders of Conditions.  The motion was seconded and accepted with a vote of 4-0-1; 4 Yes, 0 No, 1 Abstention.

GENERAL BUSINESS

        Minor Buffer Zone Activity:  21 Echo Bridge Road
        Mr. Thomas Brunner, the applicant, appeared before the Commission for the removal of    2 trees to be cut down on his property.  A Commission member asked Mr. Brunner if it    would be possible to leave a snag on one of the trees for habitat purposes.  Mr. Brunner        was not in favor of this suggestion.

        There was a motion to issue a Negative Determination with 5 special conditions; notify  Staff when the work begins, notify Staff when the work is completed, conduct the work   according to the plan, no refueling or maintenance of equipment within Conservation     jurisdiction, and any disturbance to the ground can be and should be repaired in the    season it occurred.  The motion was seconded and accepted with a vote of 5-0-0.
                
        Elections
        There was a motion to nominate Andy Tolland to continue his role from Pro Tem   Chairman to Chairman of the Conservation Commission term expiring end of June 2012.     
        The motion was seconded and accepted with a vote of 4-0-1; 4 Yes, 0 No, 1 Abstention.

        There was a motion to nominate Monique Allen as Vice Chairman of the Conservation       Commission term expiring end of June 2012.  The motion was seconded and accepted        with a vote of 5-0-0.

        Certificate of Compliance:  The Woodlands
        Mr. Alfieri informed the Commission members that he has inspected the Woodlands site    and found it to be in compliance with the Orders of Conditions and recommended that the         Commission issue a Certificate of Compliance.

        There was a motion to issue a Certificate of Compliance for the Woodlands.  The motion  was seconded and accepted with a vote of 5-0-0.

        Certificate of Compliance:  Crossway Church
        Mr. Alfieri informed the Commission members that he has recently inspected the site; the        grass is growing sufficiently and the swale area where the plants are located looks             good.  

        Mr. Alfieri recommended that the Commission issue a Certificate of Compliance for the   project.

        

        
        A Commission member questioned as to whether the growth within the rain garden is               consistent throughout from the parking lot to the Church.  This Commissioner asked Mr.  
        Alfieri if the Japanese knotweed is growing back up and requested that he revisit the site      and check before a Certificate of Compliance is issued.

        The Commission will continue this discussion and issuing of the Certificate of  Compliance until the next meeting on August 11th.

        Permit Decision:  Lot 2 South Street – CE159-1020
        There was a discussion among the Commission members regarding the issuance of   Orders of Conditions for this project.  Mr. Alfieri has attached a number of special    conditions to the Agent’s Report for the Commission’s review.

        There was a motion to confirm that the applicant has satisfied their burden of proof and        demonstrate no significant adverse impact and to issue permits with 32 Orders of        Conditions.  The motion was seconded and accepted with a vote of 4-0-1; 4 Yes, 0 No, 1  Abstention.
